This website (simplytinted.com) is operated by Simply Tinted. Throughout the site, the terms “we”, “us” and “our” refer to Simply Tinted. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein.

2. PRODUCT & PRICING POLICIES
- Tax & Shipping: All prices listed on our Site are inclusive of applicable sales tax. Standard shipping is provided free of charge for all domestic orders within the contiguous United States.
- Color Accuracy: We strive to display the “tints” of our products as accurately as possible. However, we cannot guarantee that your monitor’s display of any color will be accurate. Minor dye lot variations between production batches may occur.
- Modifications: We reserve the right to modify prices or discontinue products at any time without prior notice.
3. ORDER CANCELLATIONS & ACCURACY
- The 1-Hour Window: To maintain our fast shipping standards, order cancellations or modifications must be requested within one (1) hour of payment. Once an order enters the fulfillment process, it cannot be canceled.
- Right to Refuse: We reserve the right to refuse any order, or limit quantities purchased per person or per household at our sole discretion.
4. FABRIC & HEALTH DISCLAIMER (SKIN SENSITIVITY)
- Personal Responsibility: Our products are made from high-quality fabrics; however, we do not guarantee they will not cause allergic reactions or skin irritation. It is the user’s responsibility to check material content for known allergies.
- Pre-wear Recommendation: We strongly recommend washing all garments before the first wear.
- Limitation of Liability: Simply Tinted shall not be liable for any rashes, allergic reactions, or biological discomfort resulting from the wear of our products.
5. LAUNDERING & CARE DISCLAIMER
Simply Tinted is not responsible for damage resulting from improper laundering or care.
- Care Instructions: Damage such as excessive shrinkage, pilling, or color bleeding caused by failing to follow care instructions (e.g., using high heat or harsh chemicals) is the sole responsibility of the customer.
- Natural Wear: Natural wear and tear over time is expected and does not constitute a manufacturing defect.
6. SHIPPING & CARRIER DISCLAIMER (USPS)
- Transfer of Risk: Risk of loss and title for items pass to you upon our delivery to the carrier (USPS).
- Porch Piracy: Simply Tinted is not responsible for packages stolen after they have been marked as “Delivered” by the carrier.
- Address Errors: We are not responsible for delivery failures caused by incorrect addresses provided by the customer.
7. PROHIBITED USES
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to infringe upon or violate our intellectual property rights; (c) to upload viruses or malicious code; (d) to collect or track the personal information of others.
8. LIMITATION OF LIABILITY
In no case shall Simply Tinted, our directors, officers, or employees be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind, including lost profits or personal injury arising from your use of any of our products or services.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States and the State in which Simply Tinted is registered.
